Valid Network Ltd., its affiliates, assignees and successors (“Valid Network”, “Company”, “we” or “us”) respects the privacy of users of its website at https://Valid.network (the “Site”) and the Services and Platform provided therein (“User” or “you”) and is committed to protect the personal information that its Users share with it. We believe that you have a right to know our practices regarding the information we may collect and use when you visit and/or use our Site, Platform and/or Services. It is hereby made clear that the term “Site” shall include the “Platform” and the “Services” provided therein.
Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at http://Valid.network/Valid Network-tou (“TOU”), into which this Privacy Policy is incorporated by reference.
BY ENTERING, CONNECTING TO, ACCESSING OR USING THE SITE, PLATFORM AND/OR SERVICES AND/OR ANY PART THEREOF, YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY (THE “PRIVACY POLICY”), INCLUDING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION (AS DEFINED BELOW). IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT ACCESS OR USE THE SITE, PLATFORM AND/OR SERVICES.
FOR AVOIDANCE OF DOUBT, YOU HEREBY CONSENT TO THE COLLECTION, PROCESSING, TRANSFER AND USE OF YOUR PERSONAL INFORMATION. YOU ALSO ACKNOWLEDGE AND CONFIRM THAT YOU ARE NOT REQUIRED TO PROVIDE US WITH YOUR PERSONAL INFORMATION AND THAT SUCH INFORMATION IS VOLUNTARILY PROVIDED TO US.
NOTE THAT THIS PRIVACY POLICY APPLIES TO APPLICATIONS THAT ARE DEVELOPED AND RUN ON THE PLATFORM. THE USE OF ANY APPLICATION THROUGH THIRD PARTY VENUES EXTENDS BEYOND THE SCOPE OF THIS POLICY.
We may collect two types of data and information from our Users, who visit the Site, Platforms and/or Services:
a. Non-identifiable and anonymous information (“Non-personal Information”). We are not aware of the identity of the User from whom we have collected the Non-personal Information. Non-Personal Information is any unconcealed information which does not enable identification of an individual User, and which is available to us while such User is entering into and/or using the Site, Platform and/or Services. Non-personal Information which is being gathered consists of technical information, behavioural information and aggregated information, and may contain, among other things, the activity of the User on the Site, Platform and/or Services, type of operating system, User's 'click-stream' or searches on the Site, Platform and/or Services, type and version of browser, keyboard language, screen resolution, etc.
b. Personally, identifiable information (“Personal Information”). This information may identify an individual or may be of a private and/or sensitive nature.
c. Users of the Site, Platform and/or Services automatically provide their IP address mainly for enhancing the User’s experience and for geo-location and security purposes as further detailed below.
d. In addition, Personal Information which is being gathered consists of any personal details provided consciously and voluntarily by the User:
e. The Personal Information is collected from the details the Users provide in the Contact Forms on the Site which includes, inter alia, the User's name and e-mail address. The User can optionally provide via the Contact Form any text he/she wishes to insert into the “message box”. Once your contact details received by us, our representative will contact you for further communication. Our representative may collect additional Personal Information from you.
f. Personal Information may be collected also from the details Users may provide us while contacting us via the support e-mail address available at: info@Valid.network, when a User wishes to contact us by sending us an e-mail through the Site.
g. Users who wish to receive additional functionalities regarding the Services, such as the ability to develop, upload, test and/or operate Applications, must open an Account and provide voluntarily the following information via the registration form available on the Site: full name, e-mail address and password.
h. Users can optionally provide his/her social platforms profiles, place of work, membership in organizations and location.
i. Furthermore, Users, who wish to purchase or subscribe to certain products and/or functionalities as part of the Services will be required to provide certain Personal Information to the Online Payment Processors. During such registration process you will be required to use certain online payment method which will require you to provide to such online payment service providers certain Personal Information (such as, a credit card number and other related billing information) (see section ?8 below regarding the payment method).
For avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.
We do not collect any Personal Information from you or related to you without your approval, which is obtained, inter alia, through your active acceptance to the TOU and the Privacy Policy.
There are a few methods that we use:
a. We collect information through your entry and use of the Site, Platform and/or Services. In other words, when you are using the Site, Platform and/or Services, we are aware of it and may gather, collect and store the information relating to such usage.
b. We collect information which you decide to provide us voluntarily. For example, we collect Personal information when you contact us through the Contact Forms, or when you open an Account.
We may gather, collect and store such information either independently or through the help of our authorized third-party service providers as detailed below.
a. Use it for statistical and research purposes and for customization and improvement of our Site, Platform and/or Services.
b. Enhance the User's experience while using the Site, Platform and/or Services.
c. Learn about the preferences of Users and general trends relating to the Services (e.g. understand which features are more popular than others).
Personal Information is collected in order to:
d. Provide and personalize our Services to our Registered Users.
e. Be able to contact Users for the purpose of providing them with technical assistance.
f. Determine general geolocation information (i.e., country) from which the User's computer is connected to the Internet in order for us to know the general location of our Site's Users as well as in order to safeguard our Site, Platform and/or Services.
g. Providing you commercial and/or non-commercial materials related to our current and/or future products and services.
Valid Network will not share any Personal Information it collects with any third party, other than in the following circumstances: (a) cooperate with third parties for the purpose of enhancing the User's experience and/or in order to provide the Services; (b) to satisfy any applicable law, regulation, legal process, subpoena or governmental request; (c) to enforce this Privacy Policy and/or the TOU, including investigation of potential violations thereof; (d) to detect, prevent, or otherwise address fraud, security or technical issues; (e) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (f) to protect the rights, property, or personal safety of the Company, its Users or the general public; (g) to collect, hold and/or manage your Personal Information through the Company's authorized third party service providers (including, as applicable, their affiliates, assignees and successors as necessary to provide us with the requested services), as reasonable for business purposes, which may be located in a country that does not have the same data protection laws as your jurisdiction; (i) to enable payment through certain online payment method (see section ?8 below) (j) by virtue of undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of the assets of the Company, so long as such acquirer maintains the same privacy terms hereunder; or (k) pursuant to your explicit approval prior to the disclosure. Note, that we collect, hold and/or manage Personal Information through Valid Network's authorized third parties vendors of certain products or services (such as, hosting cloud services) (including, as applicable, their affiliates, assignees and/or successors) solely and limited to providing us with such requested services, and not for any other purposes. Such vendors may be located in a country that does not have the same data protection laws as your jurisdiction.
For avoidance of doubt, Valid Network may use Non-personal Information and transfer and disclose it to third parties at its discretion.
As may be applicable, any and all data (non-personally identifiable data and personally identifiable data) with respect to End-Users which is collected through the operation of the Application (collectively, the “Data”) shall be solely owned by Users and/or their licensors. Users hereby agree to protect the privacy of End-Users of any User Application.
Valid Network shall be considered granted an irrevocable, non-exclusive, assignable, sub-licensable, royalty-free, fully paid-up, worldwide, license to use the Data in order to provide the Services with respect to the User's Application, all in accordance with the Terms.
The Users will ensure that Data collected from End-Users through use of the Application is collected through an effective and enforced User privacy policy that (i) is based on an explicit, freely given, specific, informed and unambiguous consent of the End-Users to support lawful processing of the Data (including in relation to “sensitive information”) either by a statement or by a clear affirmative action by the End-Users ensuring that the End-Users are aware that they are giving their explicit consent to the processing of the Data and that they may withdraw their consent at any time, (ii) discloses the collection and usage (including with respect to transfer to third parties) of the Data as resulting from the use of the Application, (iii) notifies End-Users of mechanisms by which End-Users may opt out of such Data collection, and (iv) complies with all applicable privacy laws, rules, directives, and regulations, as applicable from territory to territory. Users represent and undertake that they have obtained and will obtain all legally required consents, permissions, and approvals from End-Users in order to permit Valid Network to access, store, collect, analyse, monitor and process the Data for the purpose of providing the Services (including in relation to “sensitive information” of End-Users) in accordance with the Privacy Policy. Users shall remain solely responsible and liable for, and release Valid Network from, any and all liability arising from the collection of such data by the Users and Valid Network's use of the Data as permitted herein.
If Data pertaining to you as an End-User has been submitted to us by a User as part of using the Services and/or operating the Application, and you wish to exercise any rights you may have to access, correct, amend or delete such Data, please do so by directly contacting the relevant User (or his organization). Should the User be unable to comply with such request, the User may contact Valid Network at info@Valid.network and we will acknowledge their request within reasonable time.
In any event, if for any reason you (or any person) wish to delete or modify Personal Information, please send us an e-mail with adequate detail of your request to: info@Valid.network and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws. Note that unless otherwise explicitly specified herein and/or unless you instruct us otherwise we may retain your Personal Information for as long as reasonably required for the purposes of which such Personal Information was collected, including inter alia, for the purpose of providing the Service, archival purposes, to comply with any legal obligation, resolve disputes, establish legal defences, conduct audits, enforce agreements, and/or pursue legitimate business purposes, all as permitted under any applicable privacy laws.
Aggregated and/or anonymous information derived from your use of the Site, Platform and/or Services may remain on our servers indefinitely.
In order to purchase and/or subscribe to certain functionalities of the Service, we accept certain online payment methods, such as PayPal (“Online Payment Services”) which enable Users to send and receive payments securely online using a credit card or bank account. Valid Network is not affiliated with the providers of such Online Payment Services, as each is an independent contractor, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other. The use of the Online Payment Services is at the User's discretion and sole liability. It is the User's responsibility to abide by all the terms specified by the Online Payment Services' providers in their terms of use and privacy policies, including but not limited to any age restrictions specified therein.
We take reasonable measures to maintain the security and integrity of our Site, Platform and/or Services and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures. In addition we employ highly secure services design and implementation using encryption and architectures mechanisms. Please note, however, that there are inherent risks in transmission of information over the internet or other methods of cloud storage and we cannot guarantee that unauthorized access or use will never occur. VALID NETWORK SHALL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED ACCESS, HACKING, OR OTHER SECURITY INTRUSIONS OR FAILURE TO STORE OR THE THEFT, DELETION, CORRUPTION, DESTRUCTION, DAMAGE, OR LOSS OF ANY DATA OR INFORMATION.
While using the Site, platform and/or Services, we may be using third party service providers and/or business partners whom we partnered with to offer the Services, who may collect, store and/or process the information detailed herein. Valid Network uses commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing and use of non-personal and personal information. Such software may include without limitation, Google Analytics whose privacy policy can be found at: http://www.google.com/analytics/ and PayPal which privacy policy can be found at https://www.paypal.com/us/webapps/mpp/ua/privacy-full. Please read such third party service providers' terms of use and privacy policies to understand their privacy practices.
Valid Network may offer through the Services additional features and functionalities offered by third party providers (respectively, the "Add-ons" and "Third Party Provider"). Any information that you share with the Third Party Provider is governed by their privacy policy. Valid Network is acting as an intermediary for the Third Party Provider regarding each Add-on provided to you, and shall not be considered a party to the license between you and the Third Party Provider with respect to such Add-on. Please read such Third Party Providers' terms of use and privacy policies to understand their privacy practices.
When you access or use the Site, Platform and/or Services, we or our third party service providers may use industry-wide technologies such as “cookies” or other similar technologies which store certain information on your computer or device (“Cookies”), which will allow us to enable automatic activation of certain features and make your experience much more convenient and effortless. We or our authorized third party service providers may use both session cookies (which expire once you close the Site) and persistent cookies (which stay on your system until you delete them). It is easy to disable or delete Cookies. Most browsers will allow you to erase cookies from your computer's hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you disable or erase cookies, your online experience may be limited. Cookies usually store only a Non-personal Information, such as the web pages you have visited, the duration of your browsing, etc. Valid Network does not control such third party service providers.
In order to provide the Site, Platform and/or Services, we may transfer information collected about you, including Personal Information, to affiliated entities, or to other third party service provides (as provided herein) across borders and from your country or jurisdiction to other countries or jurisdictions around the world. Please note that we may transfer such information to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to such transfer of information.
You hereby agree that we may use your contact details you provided us with (including, without limitation, e-mail address and phone number) for the purpose of providing you commercial and/or non-commercial materials related to our current and/or future products and services. You may withdraw your consent by sending a written notice to Valid Network's e-mail address that appears in the Site or alternatively follow the instructions for removing yourself from the mailing list which are available in the message transmitted to you. Please note that Registered users cannot opt out from receiving emails related to their account operation or to the Services they have purchased and/or subscribed to.
The terms of this Privacy Policy will govern the use of the Site, Platform and/or Services and any information collected therein. Valid Network reserves the right to change this policy at any time, so please re-visit this page frequently. We will provide notice of substantial changes of this policy on the homepage of the Site and/or we will send you an e-mail regarding such changes to the e-mail address that you may have provided us with. Such substantial changes will take effect seven (7) days after such notice was provided on our Site or sent by e-mail, whichever is the earlier. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Site after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes. In the event that the Terms should be amended to comply with any legal requirements, the amendments may take effect immediately, or as required by law and without any prior notice.
